Parties therefore increasingly opt for an alternative for conflict resolution: Mediation.
The impartial Hoxwier mediator does not form an opinion, but assists the parties involved in resolving their commercial disputes in the cases of damage, sales and purchases. It generally proves possible to devise a solution which is acceptable to all parties.
The following is a summary of the major benefits of mediation:
Swiftness; cost control; informal process; expert supervision; active role adopted by all parties; scope for creative solutions; no unnecessary damage to relationships; mutually acceptable solution.
The costs of a mediation process consist of:
- the fees charged by the mediator and any assistants required
- the expenses they incur.
Our mediator does not determine the outcome, but assists the parties themselves in resolving the dispute. The outcome is then laid down in a formal agreement. At this point, the mediation process and therefore HOXWIER's intervention ends.
The fees charged by the Hoxwier mediators are set in accordance with the agreements made with both parties and are not in any way dependent on resolution of the dispute. These costs are generally divided equally between the two parties. However, the parties naturally retain the freedom of choice to conclude alternative arrangements with regard to the distribution of costs.
